I think he accidentally killed her while raping her I think that's due to the "in the process of committing a specific felony" while the murder occurred portion. en.wikipedia.org/wiki/Felony_murder_rule_(California)So not while premeditated in this case, but while committing the rape. I'm NAL, though, but I think that's why it's the case. |

I would not tell on myself if it were me. If someone is going around raping and killing then I wouldn't expect them to take the moral high ground suddenly and do the right thing.
Most killers that have were cold busted. That is not the case here.

Paul Flores was moved to a new prison last week and then attacked a couple of days ago. Throat cut. Not dead. He remains in serious condition. Dept of Corrections would not really confirm attack but said it was under investigation.
Anyway, his attorney did confirm the attack.

Paul Flores was moved to a new prison last week and then attacked a couple of days ago. Throat cut. Not dead. He remains in serious condition. Dept of Corrections would not really confirm attack but said it was under investigation. Anyway, his attorney did confirm the attack. i loved the smart family attorney's comments. “It was the conduct of Paul Flores that resulted in Kristin Smart’s death. It was the conduct of Paul Flores that put him in prison where he belongs. My office and the Smart family do not condone violence. Sometimes in life, your karma comes.” |

It was extremely cool to have the opportunity to ask him whatever we wanted to about the case. He came specifically to speak to the criminology students, but because the crime happened here, they opened it up to the whole school as like a current event kind of a deal. The kids had so many good questions. Because the podcast came out a while ago at this point, the students were pretty young and didn't know a lot about. So many staff were there too to ask a million questions. |

That whole family is sick and their total indignation is maddening. At least Paul Flores is in a place where his mommy and daddy aren't covering up for and protecting him. He's been attacked at least a couple times. Cannot believe he will be up for parole in 2037, that seems awfully early. Not sure he would get out, but given he had all those extra years to roam free and assault other women it seems he could stand to wait longer to try to get out.
