Day 1 -
Gwyneth complains about camera location in the courtroom and camera being pointed at her.
the judge ended up having to take someone's camera to see what they took pics of. He reminded everyone of courtroom decorum.
Openings - his attorney says he had a full active life before this thing happened and since that time his life has deteriorated. He also brought up the inconsistent stories from ski instructors that were there that day. They say she was skiing out of control that day and she crashed into him and he was left with broken ribs and a concussion. He said an instructor berated his client on the hill while he was still down and disoriented.
Her attorney says she and her family were on a run. She is a conservative skiier. She was going much slower. She said a man bumped into her. They both fell. They bring up a ski instructor (who was a defendant in the original suit) and use his report. This report says Sanderson admitted being at fault. Her attorney says his medical issues have nothing to do with the crash.
Her lawyers brought up an email Sanderson had sent out saying "I'm famous..." with a link to meetup URL that was allegedly an article about the collision. The URL no longer works.
1) Craig R amone - he was skiing with a handful of people from a meetup group. He said he considered Sanderson an acquaintance and not a friend. He said Paltrow caused the crash. He heard a scream before seeing her slam into the back of Sanderson.
He was asked did she stay at the scene and offer assistance or asked if S was ok or injured. He said no to all those questions.
He said he only knew the other skier was Paltrow because a ski instructor who worked for the resort at the time told him "Gwenyth Paltrow just took out your buddy."
Craig also witnessed the interaction with Sanderson and Christiansen. Christiansen was an instructor and was a defendant in the initial filing. Sanderson said C filed a false report. He said S said he was the uphill skier. Craig said Sanderson was out of it and none of that was ever asked to him by Christiansen.
Craig says Sanderson was disoriented and he tried to help him down the mountain eventually flagging down help. He said Sanderson had a head injury.
2) A former partner that Sanderson dated testified. She described him as an active person with a "gentle nature." They dated for 18 months. She said they would go dancing, hiking, and traveling often.
She was told that it was said that he used to walk into walls before the accident. She said that comment suprised her.

Day 2 - doctor takes the stand despite Paltrow legal team objection
At hand was whether a doctor, being called by the plaintiff Terry Sanderson's team to testify as an expert witness, should be allowed to discuss an fMRI taken of Sanderson's brain several years before the crash with Paltrow on Deer Valley's ski slope in 2016. Sanderson's attorneys said the incident left Sanderson with a permanent brain injury.
After the recess, Holmberg called the expert witness to the stand while the jury continued to wait outside the courtroom.
Provo radiologist Wendell Gibby examined Sanderson's medical records from before and after the skiing incident in order to give his expert opinion to the court. Holmberg explained that any opinions he provided had to have a scientific basis for any interpretations, and speculation on medical issues would not be permitted.
Gibby was taken off the stand, the jury was ushered into the courtroom, and Gibby then took the stand once more for his official expert testimony.
He spoke about causes and effects of concussion and how younger people had a better chance of recovering from a concussion, while an older person was more likely to suffer serious and lasting damage.
Sanderson, who was 69 at the time of the crash, allegedly suffered a concussion in the incident. Witness Craig/Greg I forget Greg Ramone on Tuesday said Sanderson was unable to speak coherently immediately afterward and had trouble remembering his name. He also said in previously filed court documents that Sanderson "forgot how to ski" following the collision.
"Terry had been a very high-functioning, high-energy person," Gibby said. "After his accident, he deteriorated abruptly."
The doctor goes on to say that he doesn't feel that had he ran into her that he would have broken his ribs on the side of his chest. he would have been protected by his arms if he had run into her from behind. Additionally she would have broken his fall.

Defense cross examines
Paltrow's attorney pointed to a specific portion of the deposition, which suggested Sanderson's rib injuries would have come from an impact to the side, which does not necessarily line up with Sanderson's version of the day's events, which allege the "Shakespeare in Love" actress crashed into his back.
The attorney asked Gibby to clarify, since he said he didn't "think it was plausible" that Paltrow's recollection of the crash would have caused the specific injuries that Sanderson suffered.
Gibby reiterated his comment that morning that he didn't think it was plausible that Sanderson had crashed into Paltrow's back based on the fractured ribs, to which her attorney asked if it was possible.
"Anything is possible," Gibby said.
The defense also called into question Gibby's ability to testify in the first place, accusing the doctor of not thoroughly examining the documents and depositions given in order for him to form an expert medical opinion.
"Have you not testified before that you didn't have a chance to go through them all because it was just too voluminous to you?" the attorney asked.
Gibby said at the time of the deposition that was true and began explaining what he had been able to examine in the time since the deposition, but the defense didn't want to hear it and cut him off.
"No sir, I think we need to stick to the opinions you provided before," the attorney said.
The doctor reportedly testified in his own depositions that he hadn't read all the depositions word for word at the time, but he did look through them. He testified he had adequately examined the relevant documents for his medical opinion.
The amount of time between Gibby's deposition and the trial date was not discussed at this portion of the cross-examination.

Doctor on Sanderson's pre-existing conditions Sanderson's attorney asked Dr. Sam Goldstein, an expert witness for Sanderson, based off the review, assessments that were provided to Sanderson, what would be the three things that you ask from the jury?
Goldstein replied with the following comments:
1. Common sense, "do not leave your common sense at the door."
2. Sanderson may have had pre-existing issues, based off of record there was change after the incident (acute [happens very quickly] change). The pre-existing changes don't relate to the acute changes he experienced (mood, anxiety, style).
3. Not malingering (not exaggerating it), no problem in lack of effort. Continually would seek the doctors to help his conditions.

I kinda wonder if they don’t both suck. That she did crash into him but that he wasn’t seriously injured. He saw an opportunity? Idk.

I don't believe for a second that she crashed into him. I'm trying to keep an open mind and play the role of a juror but as of now, I think he's totally full of shit. Case closed.

Interesting. It's not quite as funny or silly to read all the details and claims.
If they did collide and he was left with a lasting injury, I don't honestly think it's that much to ask to have medical bills covered (Is that what he's asking for or more?) especially if he did have a concussion and has lasting issues. I also didn't realize he was 69 at the time.
Those are just my initial thoughts reading what is here so far. I haven't followed it much outside of this thread beside the memes and stuff over social media

I mean...if someone really famous knocked me over I may also send it to people? What are the chances of that happening??
I do see how it makes him look in regard to claiming lasting injuries though

Yes I’m aware you kind of ski at your own risk and know things can happen, but at the same time if you have lasting damage especially if you are older. Also with true grunting or whatever could he truly be making noises trying to get up?

Be he was knocked unconscious? was he though? the ski patrol person who treated him after the collision took the stand yesterday- not a doctor, can't diagnose. she said that although he seemed disoriented/rattled when she approached him, he passed all the tests (who, what, when, where), pupils, etc. and made no mention of being knocked unconscious. if he was, even for a brief moment, DVs protocol would've been to send him off in an ambulance. she spent a few hours with him afterwards in the first aid center while they waited on Ramone and she said his rattled-ness dissipated and his pain/discomfort was just rib pain.

Oh I hadn't heard this part. She's saying he ran into her and made these grunting noises so she thought he might have been just a creep, while he's saying she ran into him and knocked him over? Is that about accurate?

Is that about accurate? yeah you got it, but she stressed it was a fleeting thought until she realized what was actually happening. and she also added that it was a slow collision. his skis went in between her skis and the impact was on her back according to her. he's saying she collided into him and he went 'flying'. I think they both agree that they both landed- GP on top of him- with their skis tangled up.

So if we are to believe he ran into her why was she just standing on the slope? because standing on the slope is perfectly normal? Some runs are really long and you take a break, sometimes you need to wait for someone to catch up, sometimes you need to adjust something… It’s annoying when people stop in the middle of a run and not the edge but it happens always, it’s totally normal

I guess neither because he should have been paying attention?

That’s why it’s important in this case to find out who was uphill, it’s really the only thing that matters

Unfortunately collisions on the slopes are somewhat normal, some idiot adult ran into one of my sons and gave him what we later realized was a light concussion and we all just kept skiing. No one is wasting a ski day accompanying some random stranger down a mountain to make sure they're OK especially not when they ran into you. So the fact that she left the scene after both people said they were shaken up but OK is not surprising or suspicious to me at all. And like emma said the person uphill is always at fault you have to be in control of your skies at all times. It's very normal to stop during a run and it's no problem to ski around people unless it's super narrow which it wouldn't be on an easy green run. You can really stop anywhere.
