I just read a headline that a toxicologist just testified that Philando had high levels of THC in his system. It follows the defense theory that Philando caused his own death by being high.

I'm feeling nervous that the jury won't convict Yanez of manslaughter but will convict on the two counts of dangerous discharge of a firearm. It seems like a compromise I could see them reaching.
I disagree with that conclusion, but I'm starting to feel like that's the best case scenario.

I mean, it doesn't matter. He still acted cool, calm, and collected. And THC does not affect people in that way. But because people don't know and because it's illegal, it will be all "he was on DRUGS". Ugh.

In regards to that I saw this tweet...
"Toxicologist testifies there's no way to determine when someone has last smoked marijuana from post-mortem blood draw"
So maybe that speaks a little to the defense saying the marijuana made him culpable for his own death.

I got really upset ruminating about this case today, especially after listening to the Radiolab podcast that billyhorrible recommended (and reading about Hernandez, the guy who was strangled to death by a deputy's husband who isn't being charged with killing him). I am worried that people will get hung up on the wrong details and not see how dangerously and illegally Yanez acted. It shouldn't matter if Castille was high. This is irrelevant to Yanez's actions or fears, because he didn't know this information in the moment. Castille also never indicated erratic and concerning behavior, and you can't speculate on what he might have done. He wasn't given the chance. It should matter that Castille told the officer he had a gun and that he WASN'T reaching for it. It should matter that there were innocent people in the car, including a child, who could have been hurt or killed also. It should matter that Yanez reacted completely on emotion and against protocol, firing SEVEN SHOTS at man who did not have a weapon in his hands. It should matter that the other officer never reached for his weapon. I am so sick for Castille's family and other families who have lost loved ones to shootings or police incidents like these. I really hope that justice is served in this trial.

I shared this podcast on my FB page when I found it. I haven't heard much on this case in my news since the dumpster fire occupies most of the time (and the Warriors on a positive note) so I just wanted to give people a heads up on this important case.

I appreciate having been tagged into this discussion to listen to the podcast and learn more about it. I will admit that I didn't hear about the trial prior to this thread (I vaguely remember the shooting after it happened, though I never saw Diamond's video then), and likely wouldn't know that it was going on otherwise. Hopefully people on your FB page feel the same way and feel the outrage.

Yanez is testifying today. woof. I actually don't really care what he says, because obviously he's unwilling to accept any blame in the matter. But I will be stalking the 74 seconds twitter account for the play by play.

I listened to the recap of the Yanez testimony from yesterday and I feel sick.
I just think he's lying about seeing the gun.

Also, I feel a way about his partner being someone he grew up with. I'm sure that's very common in small towns and police forces. But it's like as soon as I heard that I felt like his partner was going to automatically stick up for him regardless. I'm just feeling so cynical.

I listened to the recap of the Yanez testimony from yesterday and I feel sick. I just think he's lying about seeing the gun. I do too. He didn't say that he saw the gun during his BCA interview. I also found it gross that he brought up his kid. Like his own child is somehow more deserving of a trauma-less life than the child sitting in the backseat. That really pissed me off.

I mean, I don't know man. Cops are human and every human is important, but I feel like life flashing before his eyes shouldn't be a thing he talks about in that way. As like a justification. I'm all torn up. And also, gross that he got to go home and sleep before being interviewed.

The jury is 2 black and 10 white, or that's the race everyone appears to be.

In Minnesota, all criminal cases require a unanimous jury decision in reaching a verdict.

The jury got the case at 1:10 pm. They took a lunch break and then began deliberations.

I just realized I need to listen to all of the episodes of 74 seconds about the trial. Luckily they're short, hoping I can squeeze them all in tomorrow before the (hopefully guilty) verdict is announced.

Updates from this morning, from 74 Seconds Twitter acct:
Jury asked for squad video, transcript, Facebook live video & that transcript as well. Judge allows jurors to view again in court.
judge William Leary denied jurors' request to have transcripts of videos in deliberations. Also denied them transcript of Yanez BCA intv
as jurors saw videos again, some took notes. One juror appeared to be wiping away tears as she watched Diamond Reynolds' FB live video

Why not allow transcripts? This is boggling.

Why not allow transcripts? This is boggling. yeah, I don't know the reasoning for that. And apparently the video of Yanez's interview with BCA wasn't shown in trial, and the jury requested but can't see the transcript of that interview. The transcript of the interview, in which Yanez never says he saw a gun. But the jury can't see this. ![](https://pbs.twimg.com/media/DCNo3I1XsAEOYfP.jpg)

The jury's note to the judge is now public and its lists the foreperson's name. If my Google sleuthing is accurate, this juror is the foreperson:
JUROR POOL NO. 11 – White male around 50 years old
Works for a healthcare company and has a master's degree. He believes the justice system is overburdened by victimless crimes, including prostitution and drugs. Originally from Colorado, where marijuana is legal, he said he doesn’t find pot to be a big deal. Despite moving to Minnesota more than five years ago, he reports no prior knowledge of the case.
