Today my sadness has been superseded by the long-standing irritation I have felt that RBG didn’t retire during Obama’s administration when a liberal justice could have been appointed and confirmed. The SCOTUS will likely go further to the right because appointing a justice is more important than anything else they do in office and despite Trump being an utter lunatic, he and the Senate are very United on the front of installing a conservative appointee. Her health was in serious decline welllllll before Trump took office so the fact that we are here today doesn’t really have shit to do with Trump or McConnell. It’s because she sat on the bench long after she should have. Trump is going to nominate someone just like Obama did, but unlike Obama, Trump has the Senate numbers to get his way. It’s how the American judicial and governmental processes have worked forever. Trump is a nightmare but there is a much bigger picture and as people elevate her to posthumous sainthood, I can’t help but have a fairly bitter taste in my mouth. I said I would save that for next Friday but here it is. Seconded

I think it’s a fair criticism HilarityEnsued. I think it really speaks to the confidence that the democrats had that another Dem administration would follow President Obama, which seems wild now in 2020.

I don't disagree that the decision to not retire seems foolhardy now.
But you also can't say it doesn't have anything to do with McConnell because he blocked Garland's appointment for a year and the balance we have on the court now with Gorsuch is because of McConnell. So the situation is definitely more dire because of the balance of the current court.

Theresa Greenfield in Iowa is a great place to throw money. She is virtually tied with Joni Ernst and Joni really, really needs to go. She’s a dangerous Trumper. David Wasserman (The Cook Political Report) spoke this week and said if he had to choose one of the close races that the dems have a better shot it is this one. I know someone who works on her campaign and says she’s a genuinely good person and is excited about her prospects. I gave her money last night - it made the most sense. Personally I think Kelly has enough money and McGrath has a huge uphill battle. I like the ditch Mitch model, give to the candidates who need the money and have a chance of flipping their states

I agree, that is a fair criticism. Completely understandable to feel some bitterness. I bet RBG herself spent the past year or two thinking the same thing herself. She was still an amazing woman. (Not saying that HilarityEnsued said otherwise). Unfortunately that mistake will cost all of us big time.

I'm guessing she means that the pool of people who nominate/vote on the justices are more informed by recent public opinion or voting patterns?

I think there should be a limit to how many justices can be appointed in one presidential term as well. No one party should have the ability to stack the supreme court without voters having a say.

No. You are right that the intention was not to follow public opinion or be subject to immediate political pressure, yet you see it time and again that as public opinion shifts court decisions also begin to follow with regard to rights. Publix opinion shapes law regardless of whether the founders wanted it to or not. One example- Goodridge v. dept of public health was in 2003 in mass, and as public opinion changed eventually the SC decided that bans on same sex marriage were unconstitutional in Obergefell in 2015. The shift in public opinion over that decade was HUGE in favor of gay marriage. Even now we know the AcA will likely be overturned and maybe even Roe, not because of law or precedent but power. I just feel that if there was a max term the court changing more frequently would lead to a court that better reflects the populace, and at least a guarantee that if a jurist didn't live up to expected standards they won't be on the court for 40 years. We have quite a few younger jurists now. It's likely to happen.

Senate approves SCOTUS and Dems didn’t have senate majority under Obama’s second term. You could argue she should’ve retired in his first term. I know she’s quoted as saying she wanted to go out under a female president.
In hindsight, this feels foolhardy.

I truly think there should be an upper age limit on some of the highest posts in government. I’m sorry but an 80+ year old needs to be living out the comforts of life, but having the whole country wait with bated breath to see if you kick it and throw the country into deeper political turmoil. Biden is too fucking old too, but he’s the driver of this bus we are on and I’m strapped in but I feel like we need to make changes over the next generation to bring down the frigging median age at the top ranks of government. God yes to max ages. We shouldn't have 90 year olds making laws. Even your ordinary citizen 90 year old is beyond out of touch with what the average working family is dealing with. But yes, we have what we have so sigh.

I think they’re calling it Ditch Mitch because he won’t be majority leader anymore if we flip the senate.
