I mean the loophole in the statute sucks but it's not Maguire's fault, is all I'm saying. And he's a career service guy so he wouldn't assume Tomfoolery on the part of WH Counsel AND the Attorney General. And yet.

Maguire is making the case for his behavior quite well. Agreed. It doesn’t change anything but he is explaining his thought process and it almost makes his actions understandable. Almost.

Why is it that they first asked WH council for guidance on how to deal with the complaint? Of course they are going to claim privilege. The whistleblower statutes never contemplated that the whistle would need to be blown on the president himself or herself so there was no clear statutory course of action It makes me so sad to think that our founding fathers really, truly believed that the president would always be an honorable person.

The whistleblower statutes never contemplated that the whistle would need to be blown on the president himself or herself so there was no clear statutory course of action That needs to be fixed. When something of this nature comes up, you should not go to the people the complaint is about and ask if it's ok to release it.

I can see his point. It doesn't change the fact that this is absolutely wrong and damaging to our country and national security. We need to redefine executive prilivege and codify it so that it can't be so flagrantly abused. Like the GOP is going to let that happen, lol. It's worked so well for them so far!

This system sucks. WTF is the point of a whistleblower process if they take it to WH council and go "hey bros, should we pass this along?" and let the president's decide what to do? We've never had another president that has so FLAGRANTLY thrown out norms of the office. We've unfortunately trusted POTUS to have the best interests of the country at heart and put personal aside for the good of the country

Schiff: "Would you agree that the WB complaint alleges serious wrongdoing by POTUS?"
Maguire: "The WB complaint alleged that, but it is not for me to decide"
AS: "I'm not asking you to opine on how the president conducts foreign policy, I'm asking you if this complaint is about an allegation of serious wrongdoing"
JM: "Yes, that is the subject of the complaint"
AS: And the IG found that *credible.* "Did you also find that credible?"
JM: I wasn't concerned with credibility, I was concerned with urgency. I do not question the IG's judgment

In the interest of being completely fair, Dems gave cover to Obama for using Executive authority like..... a LOT (McConnell forced his hand, which is a whole separate issue)

Schiff: Can we agree it was urgent if the pres was withholding military aid for a nefarious reason?
Maguire: It was urgent and important. But my job was to comply with the whistleblower protection act and to adhere to the legal def of urgent.

We can't just get a president with integrity back in office and say we're done. We are going to have to codify the norms and make sure that abuses of this magnitude do not happen again.

Schiff: "You sought a second opinion on whether 'shall' really means 'shall,' by going to the White House?
Maguire: I don't have the authority to waive Executive Privilege
For those following along at home, it's abundantly evident today that Schiff is a career prosecutor and Director Maguire is NOOOOOTTTTT a lawyer

I think Schiff is drilling down so hard on this to see if he can nail the WH Counsel in this whole little scheme
This reminds me of the time Devin Nunes leapt out of an Uber

Executive Privilege should not be used to suppress a whistleblower complaint. Like let's get that added now. It can be kept classified for Congressional eyes, but dear god, if something is seen as credible, it needs to be passed on.
