I was just watching that and wow. Just wow. WHY THE HELL IS HE TOUCHING HER HAIR The only 'regular protocol' thing I can think of is she's being put into the vehicle. I can't tell from the picture. But I think the normal intent of an officer holding a head is to protect against bumping the car frame. The arrest itself certainly appears to be unwarranted, to say the least.

They don't usually put both hands on the head though. It looks like he's searching her.

dc2london, that specific picture just isn't clear enough to me on my laptop to determine intent, that's all.

I did say the arrest itself appears to be more than unwarranted from media reports.
But whether the officers were placing the representative in the car per normal protocols, or whether there was another intent specifically connected to a Black person's hair, is simply not clear to me. Or even what is being shown in that particular photo - to me it looked like part of being placed in a police vehicle.
It seemed to me the original question implied that the police were specifically targeting a Black woman's hair - I just am not sure that's the case.
Not sure I should apologize or feel guilty to have that question, or observation.

It is clear to me that I do not understand this. Because you don't agree or you just don't understand the legal reasoning? IMO it is a very good precedent for future police brutality cases. I am also surprised like dc2london, didn't expect Kavanaugh to be reasonable here. Roberts was slightly less surprising.

Georgia made me so proud in Nov and Jan. So of course our elected leaders have to go full racist asshole. Ugh.

If you watch the video of her being arrested and remember back to the videos of white people leaving the capital after the insurrection on Jan 6th, you see everything you need to know about present day America.

Maybe I don’t understand because I don’t remember this case and can’t understand this particular scenario. Legal speak without being able to relate to specific tends to go right over my head - it just is just how my brain works. ETA: I completely agreed and understood the first line, it was much after that, in direct relation to the case that I didn’t not comprehend.

ETA: I completely agreed and understood the first line, it was much after that, in direct relation to the case that I didn’t not comprehend. . Not a lawyer - this is how I understood it though. Shooting someone = using force in an attempt to restrain = seizure, even if shooting someone doesn’t physically stop them. SCOTUS said nah, just because you aren’t successful in stopping someone doesn’t mean your attempts can’t be an unreasonable seizure. Cops approached this woman thinking she was a suspect, she said she thought they were carjackers and attempted to drive away, cops said she drove toward them, posing a threat, and opened fire. She got away despite getting shot. ETA I think the defense was saying there’s no 4th amendment violation because they didn’t actually seize her. This ruling says otherwise.

clucky The explanation by ozziebear is a basic rundown of the analysis. You are still "seizing" someone by shooting them in an attempt to stop/detain them with lethal force. It is a good example of how movies/tv are not always accurate of how shooting someone works. One shot doesn't immediately mean someone goes down. (I'm not saying you think that, it is just a common misconception)

ozziebear and willow, that is very helpful. Could this ruling also open doors to those who then die in police custody and the accountability (?) of the police? ETA link of what is going on here and why I’m curious

On the Georgia voting lines thing, I know this is completely insane and shouldn’t have to be a thing.. but surely there’s some sort of loophole where someone can inform people joining a voting line that there’s a tent set up around the block they can go to pick up a “line waiting kit” of some kind with snacks/water/whatever else. That’s... not the point. And the food and water thing isn’t the only voter suppression piece of this.

This is the take away I've seen all over twitter. Dan Rather agrees as well. MH asked me last night how the presser went and I unexpectedly went on a little rant about wedge issues and click bait and realized I actually was mad about the way that conference was handled by the reporters.

Someone on Twitter responded to the Law from Hell in GA by basically saying, "Let's make it so you can only buy firearms on a single day, during business hours, and you have to have multiple forms of ID and if you're disabled and can't stand in line then you're out of luck"

That’s... not the point. And the food and water thing isn’t the only voter suppression piece of this. I definitely know that. I was just trying to think of anything that can be done about something so terrible. I think GOTV efforts will have to be ramped up even more so these racist fuckers get voted out. I’d also love to see protest type actions with mass amounts of people handing out food and water in voting lines, but I wouldn’t be the one out there taking that risk. I’ll support whatever the people of Ga want to do.

Administration has taken executive action on voting rights and will take more if needed/appropriate. They strongly oppose the draconian voter disenfranchisement efforts being pushed in several states, and he supports HR 1. He continues to engage with Stacey Abrams and other leaders/activists.
