He seemed surprised in the interview that Axios knew this information and asked about it. I am wondering if he wanted this info out before midterms? Like I know this will absolutely rile up his base, but, it will also rile up the other side who was out in huge numbers protesting the Muslim ban within literal hours of it being announced.

Like, he can't just go and change the Constitution. This would set a horribly scary precedent. He can try though. There are lawyers out there who believe the POTUS has the power to overturn it, as they feel the original intended use of the amendment has not been properly followed. I mean I think it is total crap and I agree a scary precedent, mostly because of HIS intentions. No doubt it will be another court fight. His base loves this shit and he revels in it as he's a horrible racist. In the end that's what it comes down to. Also you have to own the libs before midterms am I right? Sort of like how the 2nd amendment, right? I mean, unless we have a bunch of well-armed militias with single-shot muskets ETA: Oh, hey Lady

That is the biggest load of crap. Most Americans would not be citizens if this was applied to years past.
I do think they are successfully taking over the news cycle though. No one is talking about how he and other Republicans are lying about supporting protections for pre-existing condition, the synagogue hate crime, the early voting turnout, or even the school shooting yesterday.

Oh I totally agree with you, my first thought this morning when I read this was, he's riling up his base a week before midterms. I also have no doubt that there's judges, possibly even 5 on SCOTUS, who will rule in his favor. I don't think there are 5 SCOTUS justices who would rule that the 14th amendment doesn't exist. I do think there is a chance that a conservative justice or two would rule against the EO, but I'm trying to figure out who. Roberts? Alito?

I do think that either of them would, especially if the Trump administration tries to argue against birthright citizenship for the children of documented immigrants, especially permanent residents. I’m worried about their response to the narrower argument against birthdate citizenship for undocumented immigrants. Trump lawyers could try to argue that they aren’t under the jurisdiction of US government without legal documentation. I think that argument is bullshit, since they still are subject to US laws and taxes, but that is where I see this going. ☹️
