In case you don’t know there are laws in place that require extra levels of protections in adoption cases involving Native American children such as tribal approval to place a child in an adoption outside the tribe. The laws are really important due to adoption practices in the past that amounted to government sanctioned kidnapping of Native children.

My sister shared the quote from RBG about women having a choice, etc". My uncles ex wife commented something about its her choice to keep her legs closed. I am shaking with anger. My sister works on a maternity ward and gave just a few examples of things she sees in response. I just called her a few not nice names. Her response was more mature then mine.

So it applies in cases of adoption that are outside of tribes. I’m going to listen to Rebecca Nagle’s podcast on the topic this weekend to find out more.

But also, the ICWA was a late add to tribal treaties and is still openly violated all over the country. Especially if babies are born off rez which many/most are because of lack of hospitals on rez. This could be a nightmare scenario and who knows how they'll rule because they did rule in favor of tribal nations in the Oklahoma case but they also hate women and brown women in particular so I could see them swinging the other way on this one.

I was listening to NPR last night re: SCOTUS and the Texas abortion law. Essentially it would take a case where someone sues a clinic for performing an abortion and have that appealed up to SCOTUS to rule on the merits of the law. But clinics are afraid to put themselves in that position for someone to sue and them to challenge because potentially thousands of people could sue the clinic/individuals over the one procedure.
All I can hope is that legal people can figure out a way to get it in front of SCOTUS without ruining the lives of individuals along the way. Like can we get a legal defense fund solely dedicated to paying to defend any lawsuits that would come out of one procedure while the case works its way to SCOTUS?
The other interesting thing that the guy said was that there’s nothing stopping a blue state legislature from passing that exact law but against carrying a gun. See how quickly SCOTUS responds in that case.

I’ve been seething about the Texas law and I don’t know how to get my head out of it. A big part of it is probably because at least 80% of my job involves unmarried persons who have children together and trying to make sure those children are being financially cared for by both parents, by public assistance and child support. I’m imagining how a law like this would skyrocket our caseload because of how many mothers would be forced to try and care for these children while struggling in poverty and the similarly situated poverty stricken bio fathers. The fact that conservatives still can’t wrap their heads around the ramifications of this kind of law past “saving” fetuses is so maddening to me.
I also think of how many women on our paternity caseload fill out their initial questionnaire stating the bio father told them to abort the child. Taking that access away is just… it fills me with rage.

What can actually be done about it, though? Oversight is their responsibility and that starts with hearings. Then they can draft legislation.
