Also add to this moment of zen that Parler's login box API got hacked today and all user content and information became available. ALL OF IT. Hackers have copied and holding data on all users. This should be interesting. Remember that Parler required all users to provide absurdly specific personal info to join.

Parler is not going to recover from this clusterfuck. Agreed at the end of the day it is done but I think the amount of legal drama required to get there will be a lot. At least everyone will finally understand that the 1st Amendment only applies to the government limiting an individual’s speech?

That actually helped me understand what happened. If I’m understanding the general idea, people who were “verified” provided their front and back of drivers license and now it’s easier to clearly identify those involved in the riot because of their posts.

This is great and all but any of the information gathered through the hack is inadmissible as evidence of crimes committed because it was not obtained properly. I really hope that it gives authorities the information they need to stop any future attacks but as far as being a smoking gun, it’s far from it.

If the hack was performed by law enforcement or at the request fo law enforcement or government, then absolutely. But if private persons just decided to fuck with them, then I think the private search doctrine would cover it. Because while their data was stolen, being stolen by a private party is not a violation of the Parler user's constitutional rights (no illegal search and seizure). So I think it absolutely can be used. BUt totally agree it is unlikely they'd rely wholely on this info.

trueblue you are right that there is a lot of shady and shaky legal ground here, but I also feel like a lot of the repercussions for these domestic terrorists will be felt outside the actual confines of the law. Releasing mass information about these folks and their actions to, say, their employers. Or social circles. Or small towns. Or investors/customers if they own businesses. I think the fallout will be much more widespread than just official actions taken inside the bounds of the law. My H said he thinks it will be like the Ashley Madisen release. Just put it all out there and let people panic.

A good defense attorney will argue the legally obtained evidence was fruit of the poison tree (the hack) and therefore anything developed as a result of it is inadmissible and s/he is likely going to be correct either at the trial level or on appeal.

Poisoned tree doctrine applies to evidence illegally seized by the police. If these hackers were non-government actors, and not working with the government, then there was no illegal search by police.
